These Terms of Service ("Terms") govern your use of Clearance AI ("the App"), operated by AIviation LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Description of Service
Clearance AI is an on-device speech recognition tool that transcribes Air Traffic Control (ATC) radio communications and extracts clearance information for display. All processing occurs locally on your iPhone.
IMPORTANT DISCLAIMERS
SUPPLEMENTARY TOOL ONLY: Clearance AI is a supplementary tool only. It is NOT for navigation. It does NOT replace listening to and understanding ATC communications directly.
ALWAYS READBACK TO ATC: You must ALWAYS read back clearances directly to ATC. The pilot in command is solely responsible for all clearance readbacks, compliance with ATC instructions, and safe operation of the aircraft.
AI MAY CONTAIN ERRORS: Speech recognition is not perfect. Transcriptions may contain errors, omissions, or misinterpretations, especially in noisy radio environments. NEVER rely solely on this App for clearance information.
NOT AN FAA PRODUCT: Clearance AI is NOT affiliated with, endorsed by, or approved by the Federal Aviation Administration. It is not a certified aviation product.
SAFETY OF FLIGHT: NEVER make safety-of-flight decisions based solely on information displayed by this App. Always verify clearances by listening directly to ATC and reading back as required.
2. Eligibility
You must be at least 17 years of age to use the App. By using the App, you represent that you meet this requirement.
3. User Access
Access to the App is tied to your Apple ID. We do not create separate user accounts. No sign-in or registration is required.
4. Pricing
Clearance AI is currently available as a free download during beta testing via TestFlight. Pricing may change when the App is released on the App Store.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the App
- Use the App as a primary or sole source of clearance information
- Share, redistribute, or publicly perform App content
- Use the App to create competing products or services
6. Intellectual Property
The App, including its design, code, custom speech recognition models, and documentation, is the property of AIviation LLC and is protected by copyright and other intellectual property laws.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
- WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
- WE ARE NOT RESPONSIBLE FOR ANY AVIATION DECISIONS, FLIGHT SAFETY, OR REGULATORY COMPLIANCE INFLUENCED BY USE OF THE APP.
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
8. Indemnification
You agree to indemnify and hold harmless AIviation LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.
9. Service Availability
We strive to maintain the App's availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time.
10. Termination
We may terminate or suspend your access to the App if you violate these Terms. Upon termination, your right to use the App ceases immediately.
11. Modifications to Terms
We may update these Terms from time to time. Material changes will be communicated through the App or our website. Continued use after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Florida.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIviation LLC regarding the App.
