Terms and conditions for using Clearance AI

These Terms of Use ("Terms") are a legal agreement between you and AIVIATION LLC ("we," "us," or "our") and govern your use of Clearance AI (the "App") and of clearanceai.app. By downloading, installing, or using the App -- and by accepting the one-time acknowledgement shown when you first set up the App -- you agree to be bound by these Terms and to our Privacy Policy, which Section 4 incorporates into these Terms. If you do not agree, do not use the App.

1. Description of Service

Clearance AI is a non-certified, advisory in-flight copilot. It listens to Air Traffic Control (ATC) audio through your headset, transcribes it on your device, and displays the clearances it extracts on a visual scoreboard, enriched by your device position, airport data, and your flight plan. It is display-only: it does not navigate, does not drive or command any aircraft system, and does not transmit on your behalf. It is designed to run alongside your electronic flight bag and your own listening and readback, not to replace them.

Advisory Use Only -- You Are the Pilot in Command

SITUATIONAL AWARENESS ONLY. Clearance AI is a non-certified electronic aid that provides situational awareness only. It is NOT a navigation source, NOT an Electronic Flight Bag, and NOT a substitute for listening to ATC and reading back your clearances. Do not use it for navigation or as a primary or sole source of clearance information.

AUTOMATION CAN BE WRONG. The App's transcription and clearance extraction are automated and may be incomplete, delayed, or incorrect, especially in noisy or degraded radio conditions. Always rely on the controller's spoken clearance and your own readback, not on what the App displays.

PILOT IN COMMAND RETAINS FULL RESPONSIBILITY. The pilot in command remains solely responsible for the safe and legal operation of the aircraft, for hearing and reading back ATC clearances, and for compliance with all ATC instructions and applicable regulations. Never make a safety-of-flight decision based on the App.

NOT AN FAA PRODUCT. Clearance AI is not affiliated with, endorsed by, or approved by the Federal Aviation Administration, and it is not a certified aviation product.

STERILE COCKPIT / DISTRACTION. You are responsible for managing cockpit workload and for complying with sterile-cockpit and all other operating rules. Do not let the App distract you from flying the aircraft.

2. License Grant

Subject to these Terms, AIVIATION LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App as an advisory situational-awareness aid on Apple-branded devices that you own or control. This license is for your own use; you may not redistribute, resell, or provide access to the App as a service to others.

3. Eligibility and Age

You must be at least 16 years old to use the App. If you are under 18, a parent or legal guardian must read and accept these Terms before you use the App; that parent or legal guardian is the contracting party under these Terms and is responsible for your use of the App. All purchases must be made by an adult. By using the App, you represent that you meet these requirements and that you are a pilot or student pilot, or are otherwise using the App for lawful, aviation-related purposes.

4. Privacy and Your Data

4.1 Privacy Policy incorporated. Your use of the App and of clearanceai.app is also governed by our Privacy Policy, which is incorporated into these Terms by reference and forms part of your agreement with us. It describes what the App collects, why, who receives it, how long we keep it, and the choices and rights you have.

4.2 Your acknowledgement. By using the App, you acknowledge that you have read and understood the Privacy Policy and that AIVIATION LLC will handle information as it describes. The one-time acknowledgement shown when you first set up the App records your acceptance of both these Terms and the Privacy Policy.

4.3 Conflicts. If these Terms and the Privacy Policy conflict on the collection, use, sharing, or retention of information, the Privacy Policy controls.

4.4 Contribution setting. The App's contribution setting is on by default and can be turned off at any time in Settings. Sections 2.3, 2.6, and 7 of the Privacy Policy describe what it contributes, what we do with it, and what turning it off does and does not do.

5. Recording Cockpit Audio

The App records audio from your headset while you use the live copilot and, unless you turn the contribution setting off, sends some of that audio to us. The Privacy Policy describes what is recorded, what is sent, and how long we keep it. This Section allocates responsibility for that recording.

5.1 Your authority to record. You represent and warrant that, for every listening session you start, you have the authority to record audio in your cockpit and that you have obtained the consent of every occupant of the aircraft whose speech may be captured. If you cannot obtain that consent, do not start a listening session.

5.2 What may be captured. You acknowledge that the audio the App captures is mixed cockpit and headset audio. It may include your own transmissions, transmissions by other pilots on the same frequency, and intercom or passenger speech in your cockpit -- including speech by people who are not parties to these Terms and who have not agreed to them. The App's on-device identification of controller transmissions is best-effort and is not a guarantee that only controller audio is captured or contributed. On pre-release (TestFlight) builds, the App records the entire listening session, as Section 2.6 of the Privacy Policy describes.

5.3 Recording law varies by state. Laws governing the recording of conversations differ from state to state, and some states require the consent of every party to a conversation. Florida, where AIVIATION LLC is organized, is one of them. Nothing in these Terms or in the App is legal advice, and we do not advise you on whether a particular recording is lawful where you are. You are responsible for complying with the recording, wiretap, eavesdropping, and privacy laws that apply to you and to your flight, and for any consent, notice, or posting those laws require.

5.4 Recording indemnity. In addition to and without limiting Section 13, you agree to defend, indemnify, and hold harmless AIVIATION LLC and its members, officers, employees, and agents from and against any claim, demand, proceeding, loss, liability, damage, or expense (including reasonable attorneys' fees) brought by or on behalf of any person -- including a passenger, crew member, flight instructor, student, or other occupant of your aircraft -- arising out of the recording, transmission, or contribution of audio captured through your use of the App, or out of your failure to obtain a consent that Section 5.1 requires or to comply with a law that Section 5.3 describes.

5.5 Turning it off. You can turn the contribution setting off at any time in Settings. Turning it off stops all further contribution uploads and also stops the pre-release engineering recording described in Section 2.6 of the Privacy Policy.

6. Automated Transcription and AI Disclaimer

The App uses on-device speech recognition and on-device intelligence to transcribe ATC audio and extract clearances. This automated output may contain errors, omissions, or misinterpretations of phraseology or instructions, and may lag or miss transmissions. The App displays what it heard and what it extracted; it does not verify your readback and does not guarantee that any displayed clearance is complete or correct. Always verify against the controller's spoken clearance. See the Advisory Use Only notice in Section 1.

7. Subscriptions and Pricing

Clearance AI offers a Free tier and an auto-renewable Pro subscription. All purchases are processed by Apple through StoreKit and are charged to your Apple ID.

Pricing: Current prices for the monthly and annual plans are shown in the App and on the App Store before you purchase, and may vary by region. Prices may change; any change applies to future billing periods.

Free trial: A 14-day free trial is available to first-time subscribers on the annual plan only; the monthly plan does not include a free trial. You will not be charged during the trial. If you do not cancel at least 24 hours before the trial ends, your subscription automatically converts to a paid annual subscription at the price shown at purchase. Any unused portion of a free trial is forfeited when you purchase a subscription.

Auto-renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the end of the current period, at the price shown at purchase.

Managing and canceling: You can manage or cancel your subscription at any time in iOS Settings > [your name] > Subscriptions. Cancellation takes effect at the end of the current billing period; you keep Pro access until that date.

Refunds: Purchases are processed by Apple and are subject to Apple's refund policies. Request refunds through Apple, not through us.

Device capability: Some Pro features, including the highest-fidelity clearance extraction, depend on Apple Intelligence and an eligible device. The App discloses this at the paywall. The deterministic parser and on-device transcription function on any supported device.

9. Intellectual Property and Feedback

FAA Order 7110.65 and the Aeronautical Information Manual are U.S. Government publications in the public domain; AIVIATION LLC claims no copyright in those underlying texts. The App -- including its design, code, on-device models, clearance-extraction grammar, and branding -- is the property of AIVIATION LLC and is protected by copyright and other intellectual property laws. "Clearance AI" and "AIVIATION" are trademarks of AIVIATION LLC. All rights not expressly granted in Section 2 are reserved.

Feedback. If you send us feedback, suggestions, or ideas about the App, you grant us a perpetual, irrevocable, worldwide, non-exclusive, fully paid, royalty-free license to use them for any purpose, without attribution or compensation. Please do not send us feedback you consider confidential or proprietary.

10. Third-Party Services, Other Users, and Release

10.1 Third-party services. The App and this website rely on or link to services operated by others, including Apple's App Store and a public U.S. government aviation-weather service. We do not control those services, do not endorse them, and are not responsible for them. You use them at your own risk, and the operator's own terms and privacy practices apply.

10.2 Other users and other aircraft. We are not responsible for the conduct of other users of the App, or for the content of radio transmissions the App receives, including transmissions by other aircraft and by controllers.

10.3 Release. To the fullest extent permitted by law, you release AIVIATION LLC and its members, officers, employees, agents, successors, and assigns from all claims, demands, and damages of any kind arising out of or related to your use of a third-party service or your interactions with other users. If you are a California resident, you waive California Civil Code Section 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. TRANSCRIPTION AND CLEARANCE EXTRACTION MAY CONTAIN ERRORS AND ARE NOT A SUBSTITUTE FOR LISTENING TO ATC, READING BACK CLEARANCES, OR THE JUDGMENT OF THE PILOT IN COMMAND.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Some states do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless AIVIATION LLC and its members, officers, employees, and agents from and against any claim, demand, proceeding, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of (i) your use of the App, (ii) your violation of these Terms, (iii) your violation of any applicable law or regulation, or (iv) the recording of audio through your use of the App, as further described in Section 5.4. We may assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with that defense. You may not settle any such matter without our prior written consent. We will use reasonable efforts to notify you promptly of a claim for which we seek indemnification.

14. Service Availability

We strive to keep the App available but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. We have no obligation to provide support or maintenance for the App, though we may choose to do so.

15. Term and Termination

These Terms take effect when you first accept them or first use the App, and remain in effect until terminated. We may suspend or terminate your access to the App if you violate these Terms. You may terminate at any time by deleting the App; deleting the App does not by itself cancel a subscription, which you cancel through Apple as described in Section 7. Upon termination, your right to use the App ceases immediately. Sections 4, 5, 9, 10, 11, 12, 13, 17, 18, 19, 20, 21, and 22 survive termination.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new effective date. Continued use of the App after the new effective date constitutes acceptance of the updated Terms.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. You and AIVIATION LLC consent to the exclusive jurisdiction and venue of the state and federal courts located in Florida, except that (a) either party may bring an action in any court of competent jurisdiction for injunctive or other equitable relief to protect its intellectual property rights, and (b) either party may bring an individual action in small claims court within that court's jurisdictional limits. Nothing in these Terms limits any non-waivable rights you may have under the consumer-protection laws of your state of residence, or requires a California resident to litigate a controversy arising in California outside California or under another state's law.

18. State-Specific Notices

This Section applies to you only to the extent you are subject to the law of the state named. If a provision here conflicts with another provision of these Terms, this Section controls for users subject to that state's law.

18.1 California. Under California Civil Code Section 1789.3: The provider of this service is AIVIATION LLC, c/o Northwest Registered Agent, 7901 4th Street North, Suite 300, St. Petersburg, FL 33702, telephone 316-302-5551. Charges for the service are the subscription and in-app purchase prices displayed in the App before purchase. To resolve a complaint or obtain further information, write to us at the address above or email support@aiviation.dev. You may also contact the Complaint Assistance Unit of the Division of Consumer Services, California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, telephone (800) 952-5210.

18.2 Nevada. Under Nevada Revised Statutes Chapter 603A, Nevada residents may direct a business not to sell certain personal information. AIVIATION LLC does not sell personal information. Our designated address for these requests is privacy@aiviation.dev.

18.3 Colorado, Connecticut, and Virginia. Residents of these states may have additional rights under their state privacy laws, including rights of access, correction, deletion, portability, and appeal. Those rights, and how to exercise them, are described in Section 8 of our Privacy Policy.

18.4 Other states. Residents of other states may have similar rights; see our Privacy Policy.

19. Additional Terms for Apple Devices

The following apply because you obtained the App through Apple's App Store:

20. General

20.1 Export. You agree not to export, re-export, or transfer the App or any technical data obtained from it in violation of U.S. export-control laws or the applicable regulations of any other country.

20.2 Electronic communications. You consent to receive communications from us electronically. Clearance AI has no account, and we hold no email address for you, so we give notice by posting it in the App or on clearanceai.app. You agree that a notice given that way satisfies any legal requirement that a communication be in writing, and you are responsible for checking those places. If you give us an email address -- for example, by contacting support -- we may also use it to reach you about that matter.

20.3 Accessibility. We are committed to making the App and this website usable by everyone, including people with disabilities, and we endeavor to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. If you have difficulty accessing any part of the App or this website, or a suggestion for improving accessibility, email support@aiviation.dev. We will make reasonable efforts to respond promptly.

20.4 No waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other.

20.5 Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign them freely, including in connection with a merger, acquisition, or sale of assets. These Terms bind any permitted assignee.

20.6 Interpretation. In these Terms, "including" means "including without limitation." Headings are for convenience only and do not affect interpretation.

21. Severability

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the remaining provisions remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIVIATION LLC regarding the App and clearanceai.app, and supersede any prior agreement or understanding on that subject.
